As HEKTAR YAPI MÜHENDİSLİĞİ, in the text of this "Information Form" that we have prepared in the capacity of Data Controller within the framework of Article 10 named "Information Obligation of the Data Controller" and Article 11 named “Rights of the Related Person” in accordance with the Personal Data Protection Law; there are information about for what purpose your personal data will be processed, to whom and for what purpose your processed personal data can be transferred, the method and legal reason for the collection of your personal data, and your rights to request information, correction and other rights regarding your personal data listed in Article 11 of the PDPL. Any up-to-date information about you that you have shared with our company within the scope of PDPL will be considered as "Personal Data", and this data will be stored in the most secure way possible, in accordance with the conditions stipulated by the legislation and the procedures and principles set forth below.

a) Data Controller

Your personal data can be processed by HEKTAR YAPI MÜHENDİSLİĞİ as a "Data Controller" within the scope of the following in accordance with PDPL. Pursuant to the PDPL, your personal data that you have submitted to HEKTAR YAPI  MÜHENDİSLİĞİ can be recorded, stored, maintained, updated for the continuation of the services, changed, edited, shared with third parties, classified and processed within the scope of the purposes described below within the framework stipulated by the PDPL.

b) Which Personal Data Will Be Processed In Which Ways

Within the framework of your benefiting from the products and services of HEKTAR YAPI MÜHENDİSLİĞİ, the following personal data are processed through our sales offices, our website and other channels:

- Your clear identity data such as name, surname, TR Identity Number, date of birth, place of birth,

- Your address, telephone number, e-mail address and other contact data,

- All kinds of information, including information about the immovable related to the product/service you have purchased, and your payment information regarding them,

- Your other personal data that you have personally transmitted within the framework of your requests, suggestions and complaints,

- If you use our websites, your behavior and digital trace information obtained through cookies,

- Your voice call recordings kept in accordance with company standards,

- Your camera recording images during your visit our sales offices or workplaces.

HEKTAR YAPI MÜHENDİSLİĞİ does not process data related to race, ethnic origin, political thought, philosophical belief, religion, sect or other beliefs, costume and clothing, association, foundation or union membership, health, sexual life, criminal conviction and security measures, and sensitive personal data such as biometric and genetic data.

c) For What Purposes Your Personal Data Will Be Processed

Your personal data listed below may be processed for the purposes of;

- Performance of the contracts signed with the products and services offered,

- Informing about products by means of e-mail and online advertising,

- Presenting special campaigns and promotional activities related to our products/services and analysis of the data we process within this scope within the framework of statistical and planning activities,

- Managing customer satisfaction and complaints; fulfillment of requests transmitted through channels such as our sales offices, our website, etc.; conducting customer satisfaction surveys,

- Solving problems related to products and services,

- Procurement of services from external sources such as the development of products and services and the acquisition of technology and infrastructure services,

- In accordance with the relevant legislation; Preparation of mandatory information and documents within the framework of operation, storage and sharing of information requested by public institutions and organizations, fulfillment of notification obligations and fulfillment of other legal obligations,

- Taking all necessary technical and administrative measures in order to ensure the security of our systems and applications,

· Sharing information and documents that are essential for the conduct of business with our business partners within the framework of the presentation and development of our products and services, and for other similar purposes.

In addition, your personal data may be processed in accordance with the provisions of Turkish Code of Obligations No. 6098, Turkish Commercial Code No. 6102, Consumer Protection Law No. 6502, Law No. 6563 on the Regulation of Electronic Commerce and their secondary legislation provisions, obligations arising from tax legislation, and the cases required by other competent public authorities and in accordance with the provisions of other relevant legislation. It can be transferred to the physical and/or electronic archive and information systems of HEKTAR YAPI MÜHENDİSLİĞİ and can be kept under preservation both in digital and physical environment.

- Especially the third parties we consult, including lawyers, tax consultants and auditors, as well as our business partners.

e) Legal Reasons for Processing Your Personal Data

Your personal data is processed by HEKTAR YAPI MÜHENDİSLİĞİ in line with the above-mentioned purposes and in full compliance with the principles specified by the Law, in order to provide products and services and to ensure the proper performance of the rights and obligations regulated by the law.

f) Your Rights as Personal Data Owner

Within the scope of the law; You have the right to learn whether your personal data is processed, to request information if your personal data has been processed, to learn the purpose of processing your personal data and whether they are used in accordance with its purpose, know the third parties to whom your personal data is transferred at home or abroad, to request correction of your personal data if it is incomplete or incorrectly processed, to request notification of third parties to whom personal data has been transferred about procedures regarding the correction of them and/or the deletion or destruction of personal data, in case your personal data is incomplete or incorrectly processed, to object to the possibility of unfavorable results in the event that your processed data is processed exclusively through automated systems, to demand the compensation of the damage in case of damage due to the unlawful processing of your personal data. Your requests within this scope included in your applications will be concluded as soon as possible and free of charge, within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Board may be charged. If the application is made due to an error caused by HEKTAR YAPI MÜHENDİSLİĞİ, the fee will be refunded. Pursuant to paragraph 1 of Article 13 of the PDPL, you may submit your request regarding the exercise of your above-mentioned rights to HEKTAR YAPI MÜHENDİSLİĞİ in writing or by other methods determined by the Personal Data Protection Board. As the Personal Data Protection Board has not determined any method in the current situation, you must submit your application in writing to HEKTAR YAPI MÜHENDİSLİĞİ in accordance with the PDPL. In this context, the channels and procedures to submit your application in writing are explained in the applications you will make within the scope of Article 11 of the HEKTAR YAPI MÜHENDİSLİĞİ PDPL. In accordance with Article 13 of the PDPL, you can send your application request in writing to HEKTAR YAPI MÜHENDİSLİĞİ. You can send your application request by filling in the form on our website and adding your ID photocopy and other contact information, with wet signature, to the address “Sarıyakup Mahallesi, Taberdar Sokak, HEKTAR PLAZA LOFT CENTER No: 3 / 1 Karatay - KONYA”, to the Customer Relations Department in person or via a notary public, by registered letter with return receipt or an e-mail to info@teknikyapi.com e-mail address. HEKTAR YAPI MÜHENDİSLİĞİ reserves the right to make changes in the codes of practice and the text of this information and consent letter due to the changes that can be made in the PDPL and other relevant legislation, and the principles to be determined by the Personal Data Protection Board.

g) Circumstances Not Requiring Consent

HEKTAR YAPI MÜHENDİSLİĞİ, as the data controller, has the right to process personal data without obtaining explicit consent in cases where data processing is necessary for its legitimate interests in accordance with the 2nd paragraph of Article 5 of the PDPL, If it is clearly stipulated in the laws, if it is necessary to process the personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract, if it is obligatory for HEKTAR YAPI MÜHENDİSLİĞİ to fulfill its legal obligation as data controller, is made public by the relevant person, if the data processing is mandatory for the establishment, exercise or protection of a right, provided that it does not harm the fundamental rights and freedoms of the relevant person.
